1. Acceptance of Terms
By accessing or using the Memoria platform operated by FunClickUSA, LLC, doing business as Beznostech ("Company," "we," "us," or "our"), you agree to be bound by these Terms and Conditions. If you do not agree, do not use our services.
2. Description of Service
Memoria is a collaborative memory storytelling platform that lets friends and family recreate shared moments together. A creator starts a memory event, invites contributors via private links, gathers their written memories, photos, and voice notes, and uses AI to weave all contributions into a single illustrated story that can be published publicly or kept private.
3. Account Registration
- You must provide accurate and complete information when creating an account.
- You are responsible for maintaining the confidentiality of your login credentials.
- You are responsible for all activities that occur under your account.
- You must be at least 18 years old to use our services.
4. Acceptable Use
You agree not to:
- Use the service for any unlawful purpose or in violation of any applicable laws.
- Upload content that is hateful, harassing, defamatory, or that violates another person's privacy or rights.
- Share invitation links with the intent to spam, harass, or collect data about others.
- Attempt to gain unauthorized access to any part of the service or to another user's private memories.
- Reverse engineer, decompile, or disassemble any part of the platform.
- Upload malicious files, viruses, or harmful code.
5. Your Content and Memories
You retain ownership of the memories, photos, and audio you submit. By contributing to an event, you grant:
- The event creator the right to review, moderate, and include your contribution in the collaborative story for that event.
- FunClickUSA, LLC a limited license to host, process, and display your content solely to provide the service — including generating AI stories from the contributions you have consented to share.
You represent that you have the right to share any content you upload, including photos or recordings of other people, and that you have obtained any necessary permissions from them.
6. AI-Generated Stories
Stories are generated by AI from the approved contributions to an event. AI output may contain inaccuracies, and any historical facts added for context should be verified independently. Event creators are responsible for reviewing stories before publishing them. We do not use your content to train AI models.
7. Subscriptions and Billing
Paid plans are billed through our payment processor, Stripe. Prices are shown at checkout and may be subject to applicable taxes. Subscriptions renew automatically until cancelled; cancellation takes effect at the end of the current billing period. Plan changes are prorated and take effect immediately. Payments are non-refundable except where required by law.
8. Intellectual Property
The Memoria platform itself — including its software, design, logos, and branding — is the exclusive property of FunClickUSA, LLC and is protected by intellectual property laws. This does not affect your ownership of the content you submit, as described in Section 5.
9. Your Data
Our handling of your personal data is governed by our Privacy Policy.
10. Disclaimer of Warranties
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT AI-GENERATED CONTENT WILL BE ACCURATE OR COMPLETE.
11. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, FUNCLICKUSA, LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, OR DATA, INCLUDING LOSS OF MEMORIES OR CONTENT STORED ON THE PLATFORM.
12. Indemnification
You agree to indemnify and hold harmless FunClickUSA, LLC (DBA Beznostech), its officers, directors, employees, and agents from any claims, damages, losses, or expenses arising from your use of the service, your content, or your violation of these Terms.
13. Termination
We may suspend or terminate your access to the service at any time for any reason, including violation of these Terms. Upon termination, your right to use the service ceases immediately. You may delete your account at any time from your settings.
14. Changes to Terms
We reserve the right to modify these Terms at any time. Material changes will be communicated via email or a notice on the platform. Continued use after changes constitutes acceptance.
